1. Acceptance of Terms
By engaging Beach City Services LLC ("Beach City Aerial," "we," "our," or "us") for aerial photography services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services Description
Beach City Aerial provides professional aerial photography services using FAA-compliant drone operations. Our services include but are not limited to:
- Real estate aerial photography
- Commercial and construction site documentation
- Wildlife and nature photography
- Event coverage and special projects
3. Booking and Payment Terms
Deposits and Payments
A 50% deposit is required to secure booking dates. Full payment is due upon completion of services. We accept major credit cards, bank transfers, and approved payment methods.
Cancellation Policy
Cancellations made 48+ hours before scheduled shoot date receive full deposit refund. Cancellations within 48 hours may forfeit deposit. Weather-related cancellations are handled on a case-by-case basis.
4. Weather and Scheduling
Aerial photography is weather-dependent. We reserve the right to reschedule shoots due to unsafe flying conditions, high winds, or poor visibility. Every effort will be made to accommodate your preferred dates, but weather takes precedence for safety and quality.
5. Permits and Permissions
Client is responsible for obtaining any necessary permits or permissions for aerial photography on private property. We handle all FAA-required authorizations for drone operations. Additional fees may apply for special permits or restricted airspace.
6. Intellectual Property and Usage Rights
Copyright Ownership
Beach City Services LLC retains copyright ownership of all original photographs. Upon full payment, clients receive a license to use the images for their intended commercial or personal purposes.
Usage Restrictions
Images may not be resold, sublicensed, or used for purposes other than those specified in the original agreement without written permission.
7. Delivery and Revisions
Edited images are typically delivered within 5-7 business days. One round of minor revisions is included. Additional revisions or extensive editing may incur extra fees. Rush delivery options are available for an additional cost.
8. Limitation of Liability
Beach City Services LLC liability is limited to the amount paid for services. We are not liable for indirect, incidental, or consequential damages. Drone operations carry inherent risks, and we maintain appropriate insurance coverage.
9. Force Majeure
We are not liable for delays or failures caused by events beyond our control, including but not limited to weather conditions, FAA restrictions, equipment failure, or acts of nature.
10. Governing Law
These terms are governed by the laws of South Carolina. Any disputes will be resolved in the courts of Beaufort County, South Carolina.
